Standard Terms and Conditions
1. All prices quoted are our best estimate for the work specified by the client. Actual on-site conditions may impact on the cost of erecting the proposed signage. Every effort has been made to anticipate contingencies, but material differences on-site, or in your requirements will change the validity of any quote.
We will advise you before we commission any work that will attract additional fees.
2. Before Ashanti Contract Management t/a New Image Signs & Print processes your order, all jobs valued at less than R10,000.00 excluding VAT require a 100% upfront non-refundable payment. All other jobs require an 80% upfront non-refundable payment. Should a job consist of multiple elements, all listed separately on the quote and invoice, a tranche payment will be required for each individual element, once each individual element is completed. No cross subsidization of individual element of signs will be allowed. Full payment to be received before goods for collection, cross border or local delivery will be released.
3. The balance of the quote, and any other agreed additional charges, becomes due and payable on delivery/installation of the job.
4. Cash deposit fees will be borne by the depositor, alternatively additional 10% will be added to the final invoice for such fees.
5. On your order we will commit to a final delivery date.
6. Should we miss the committed written deadline, through reasons within our control, we will immediately credit you with 5% of the job price.
7. All work will be done in normal weekday work hours. If the task moves into weekend time as a result of changes you make, overtime charges will apply.
8. Our work carries the Ashanti Contract Management t/a New Image Signs & Print guarantee. The details of this vary from job to job, but our minimum standards are:
• 12 months guarantee on all workmanship
• Cut vinyl used will not shrink, fade, peel or crack within 36 months of erection
• Paints used will not fade, peel or crack within 12 months of erection
• Prints are expected to last up to a maximum 36 months outdoors, depending on the colour and proximity to the sun.
9. This quote is valid for 14 days and because of the fluidity of the rand exchange rate will be confirmed on receipt of order.
10. Suitable artwork is to be provided by you. In the case that the artwork has to be created, or reworked to make it suitable for use, we reserve the right to charge for this service at R480.00 per hour. The file must be in PC format. The file must be in a VECTOR format (no rasters or bitmaps). Any text to be converted to curves. Ideally drawing should be full size. File format may be either: *.eps, *.cdr, *.plt, *.ai (version 3).
11. All signage work done remains the property of Ashanti Contract Management t/a New Image Signs & Print until paid in full.
12. This quote includes all electrical components within the sign but specifically excludes running power to and connecting the sign.
13. All goods not paid within seven (7) days from receipt of invoice or statement as per negotiated terms, will be charged interest at the current prime rate of First National Bank plus five (5) percent.
14. This quote supersedes and nullifies all previous quotes.
15. Without prejudicing the above, Ashanti Contract Management t/a New Image Signs & Print cedes all responsibilities for ownership and maintenance of the sign (without detracting from the guarantee), and takes no further responsibility for the same, once the sign has been erected and Ashanti Contract Management t/a New Image Signs & Print also hand over all responsibility for personal and any other liability at the time of hand over. Please note that Ashanti Contract Management t/a New Image Signs & Print carry contractor’s insurance that covers the sign UNTIL it is installed. Once your sign(s) is/are installed, Ashanti Contract Management t/a New Image Signs & Print recommend that you cover the sign(s) under your standard property insurance contract.
16. I understand that by accepting this quote I am also waiving and abandoning the defence of prescription to any claim that Ashanti Contract Management t/a New Image Signs & Print should have against me for outstanding payment.
17. No indulgence or latitude by or failure of Ashanti Contract Management t/a New Image Signs & Print to enforce any of the terms of this document shall constitute a waiver of any of its rights, which shall not thereby be precluded from exercising any rights which may have arisen in the past or may arise in the future.
18. No amendment or agreed alternation to the above terms shall be of any force or effect unless recorded in writing and signed by both parties.
19. Where you have been given a price per sign, please note that if less than the full number of signs quoted on is ordered, the price per sign may increase to cover additional transport and all fixed costs.
20. Unless otherwise stated, the delivery and/or installation of the quoted signs requires between seven (7) and ten (10) working days from the last date, being the order being received, deposit payment being received and artwork being signed off.
21. Ashanti Contract Management t/a New Image Signs & Print only work with trained professional staff, agents and contractors. As such, while every care will be taken while working on your premises, Ashanti Contract Management t/a New Image Signs & Print and its agents or contractors cannot be held liable for any peripheral damage such as broken glass, that is not caused by any direct action.
22. Any provision in this Agreement which is or may become illegal, invalid or unenforceable shall be ineffective to the extent of such prohibition or unenforceability and shall be treated pro non scripto and severed from the balance of this Agreement, without invalidating the remaining provisions of this Agreement or affecting the validity or enforceable of such provisions.
23. The quote to be signed and returned and if not signed and returned, the deposit payment will be considered tacit agreement to Ashanti Contract Management t/a New Image Signs & Print terms and conditions.
24. I agree that in the event of any breach, specifically non-payment, I commit to be liable for all collection costs incurred.
25. Should it become necessary for Ashanti Contract Management t/a New Image Signs & Print to institute legal proceedings for any reason whatsoever, it is agreed that legal action will fall under the jurisdiction of the magistrate’s court for the district of Johannesburg not withstanding the amount being claimed. In the event of legal proceedings being instituted, it is understood and agreed the client/company shall be liable for Ashanti Contract Management t/a New Image Signs & Print costs on the scale as between attorney and own client and also all collection commissions and fees in accordance with the applicable tariff.
26. I confirm that I am authorized and entitled to sign and commit myself and my business to the terms and conditions of this quote.
27. Should standing time be required we will request such in writing and commit to pay for such standing time at an agreed rate.
